Slip and fall….do I really need a lawyer?

Hi I slipped and fell in a major department store on some drops of water that must’ve been drug in from another customer from the rain. Store management came over and I filled out an accident report. Less than 24 hours later, I had to go to the ER and found that I have a severe ankle sprain and needed a brace and crutches. I also missed 2 days of work and possibly more because of the injury. The company did contact me a day later for a follow up, i told them I had to go to the ER and they said they would forward my file to the claims department and they would call me back in a few days. There is video of me falling from the stores cameras. Should I hire a lawyer or trust that the company’s insurance will compensate me for medical bills and loss of wages? I don’t want to sue and I don’t want to have to pay a bunch off legal bills, but I need compensation for at least the things mentioned above. Any advice? Thank you for any help you can offer.

Look for an attorney in your area who will work for a percentage of the money you receive.

If they filed a claim, that means that are taking responsibility. I believe I know which store this is because of the procedures you went through. Major stores like that are good at following through with their claims and giving compensation. If they don’t call you back in a few days like they promised give me a call and see if they can check on the claim for you. I would call a lawyer if the store or insurance company is not cooperating with you. Hope you don’t have to do that.

Many lawyers offer free consultations so that you can talk to one before you decide whether to pay for representation.

Well, no use giving away 40% right off the bat to a lawyer. If you’re not looking for pain & suffering, they’ll probably offer you your medical bills and lost wages right off the bat, no arguing. They *might* even through in $500 for pain & suffering.

I’d wait. You don’t NEED a lawyer, unless they start giving you a hard time about paying the bills.

If you are satisfied that you are getting your bills paid and lost wages paid, a lawyer will cost you 40% of any potential settlement you might get. However don’t now think you will get a whole ton of money as a settlement, cause you won’t. If you get an attorney, and file a large lawsuit, then it could take years and you could still end up with nothing. As long as you feel you are being fairly treated, I would not bother. If that situation changes, then you can certainly consult with one.
