Workers Compensation?

by admin on November 4, 2010

I attended my first workers compensation deposition today. I was very nervous because I also have no attorney to represent me. I think I answer all questions as truthfully and accurate as I could without showing frustration. Although my injury happen 3 years ago she ask me about an incident that happen 12 years ago that at the time of the question I answered no. I realize after it was all over that yes years ago I did have a fender bender and did she a Dr. for a short period of time. She also ask questions about my husband like his name and where he works which to me is irrelevant to my issue. Can anyone tell me what I can do to fix my boo boo? It was not like I was trying to hide anything it was that it was so long and not a big issue. My concern is that if they will try to use this against me and say I was already injured before with the same body part. My claim has already been accepted and is close to making a determination on my disability. It this something I need to let them know or should I just let unless it is brought back to my attention? Will this have any affect on my claim the Qualified Medical Evaluator has already said I will be about 16 percent and will get future medical although I have not seen him for my final appointment yet. Please good advice only.

if you did not declare the pre-existing condition when they ask you to, that’s non-disclosure and it is your fault, you can’t say that you forget. if all the while nobody ask you for the info then you have nothing to worry about. i am not too sure for your state but in my country, when a company purchase a workman injury compensation, the insurer did not ask for pre-existing condition and it is payable so long as the injury is work related.
